Clothing Consignment Agreement

Don't Be Chy Boutique Clothing Consignment Agreement 

This Consignment Agreement ("Agreement") is entered into between Don’t Be Chy Boutique ("Store") and the undersigned consignee ("Consignee") on the        day of                                                     of 20                      .

Consignment Items - Consignee agrees to consign the following items ("Items") to the Store:

Duration of Consignment - The Items will be displayed in the Store for a period of 90 days from                         day of                                  of 20              to the              day of                                     of 20                      . Consignee agrees to pick up their Items within two (2) weeks from the end date. The end date will be specified upon agreement between both parties.

Unclaimed Items - If the Consignee fails to pick up the Items within a period of two (2) weeks after the agreed pick-up date, the Store reserves the right to either donate the Items to a charitable organization or put them on sale at a discount of up to 70% off the original price.

Sales and Discounts - Consignee shall set the selling price of each Item, and the Store may provide suggestions for pricing, but ultimately Consignee retains the authority to determine the selling price. Consignee acknowledges that the Store is not responsible if Items do not sell at the price set by Consignee.

Condition of Items - Consignee warrants that all Items are in good condition and suitable for sale. The Store reserves the right to refuse any Items deemed unsuitable for sale.

Pricing - Consignee will receive payment for sold Items in a single payout within 10 business days of the end date of their consignment duration.

Consignment Fee - The consignor agrees to pay the consignee a consignment fee equal to twenty-five percent (25%) of the total sales price of each item sold, calculated before any applicable taxes. The consignment fee shall be deducted from the gross proceeds of the sale, and the remaining balance shall be remitted to the consignor.

Payment - Consignee will receive payment for sold Items within 10 days of the end of the agreement.

Termination - Either party may terminate this Agreement by providing written notice or email to the other party within 10 days of the desired termination date. Upon termination, Consignee agrees to promptly pick up any unsold Items before the termination date.

Liability - The Store is not responsible for any loss, theft, damage, or destruction of Items while in its possession. Consignee acknowledges and agrees that they assume all risk for any loss, theft, damage, or destruction of Items while they are on consignment with the Store.

Governing Law - This Agreement shall be governed by the laws of Alberta.

By signing below, Consignee acknowledges that they have read, understood, and agreed to all terms and conditions outlined in this Agreement.
